Enforced by the Federal Trade Commission, the Funeral Rule makes it possible for you to choose only those goods and services you want or need and to pay only for those you select, whether you are making arrangements when a death occurs or in advance.
Your Key Rights
Buy only what you want
You have the right to choose the individual goods and services you want (with some exceptions). You do not have to accept a package that includes items you don't want.
Get price information
Funeral directors must give you price information on the telephone if you ask for it. They must also show you a General Price List (GPL) when you visit.
Alternative containers
If you choose cremation, you have the right to use an alternative container (cardboard or unfinished wood) instead of a casket.
Provide your own casket
You can purchase a casket or urn from a third party, and the funeral home cannot charge a handling fee.
Common Misconceptions
Embalming is required by law.
False. Embalming is not required by law in most cases, though some states require it if burial doesn't happen within a certain time frame. Direct cremation and immediate burial do not require embalming.
You must buy a vault.
Mostly False. State laws do not require a vault. However, many cemeteries require some type of outer burial container to prevent the grave from sinking.
